Privacy policy

In accordance with EU GDPR 2016/679; Spain’s Organic Law 3/2018 on the Guarantee of Digital Rights; Law 34/2002, with the latest update on 09/05/2023, on Information Society Services and Electronic Commerce; and Law 11/2022, General Telecommunications, ATENEU INSTRUCTIU informs users of its websites that we are obliged to maintain professional secrecy regarding personal data collected through the registration or contact forms on our pages. This obligation will continue even after our commercial or contractual relationship has ended, and in no case will we make public the personal data of visitors and clients on the website without their consent.

Data subject consent

To process your personal data with privacy and security, we need your consent, in compliance with EU GDPR 2016/679, articles 5, 6, 7, and 13; Spain’s LOPDGDD 3/2018, Title II; and Law 1/2019 on trade secrets. The data controller will be ATENEU INSTRUCTIU, which will process the information lawfully, fairly, and transparently in relation to the data subject, for specific, explicit, and legitimate purposes. The data and information will be processed in a way that ensures adequate security through appropriate technical and organizational measures.

Data will only be transferred to the data subject where legally required, and you have the right to file a claim with the relevant Supervisory Authority.

In the event of a personal data breach, under GDPR article 33, the data controller shall notify the competent supervisory authority in accordance with article 55, without undue delay and, where feasible, no later than 72 hours after becoming aware of it.

When contacting or registering on this website, you provide your personal or legal data for the management of your data as a user. By means of a check box or button in the contact form, you accept the terms and conditions for the processing of your personal data.

The data subject has the right to withdraw consent at any time. Withdrawal of consent shall not affect the lawfulness of processing based on consent prior to its withdrawal.

Consent of minors

Article 6.f of EU GDPR 2016/679 and Spain’s LOPD-3/2018 on the Guarantee of Digital Rights, in article 84 (protection of minors on the internet), establish that minors under 16 years of age may not give consent for an online business to collect their personal data. Only their legal representatives (parents or guardians) may do so on the minor’s behalf, unless the minor is over 16 years of age, in which case their consent would be lawful.

Sending your data through the form(s) on our website will be strictly conditional on you having read and accepted the Privacy Policy, via a mandatory check box at the bottom of the registration or contact form.

Cookie reservation

ATENEU INSTRUCTIU uses cookies and other similar technologies that store and retrieve information while you browse. These technologies may have various purposes, such as recognizing a user and obtaining information about their browsing habits. The specific uses of these technologies are described in the information contained in the Cookie Policy. In accordance with the entity’s data protection policy, ATENEU INSTRUCTIU informs that cookies are associated with the anonymous user and their computer, and do not by themselves provide personal data about the user.

Our Cookie Policy informs the user of the time these cookies remain active on their device and the possibility that third parties may access the information they store. For this reason, article 5(3) of Directive 2002/58 was amended by Directive 2009/136, and now by the AEPD Guide.

The latest AEPD Guide on the use of cookies (July 2023), which incorporates the criterion of the European Data Protection Board (EDPB), states that accepting or rejecting cookies must be offered at the same level, without one option being more complex than the other. In this regard, the user must be able to explicitly accept or reject the use of cookies and receive more information about them. Additionally, the User can configure their browser to be informed of the receipt of cookies and may, if they wish, prevent their installation on their hard drive.

Exercise of rights

These data will be entered into an automated file under the responsibility of the website administrator of ATENEU INSTRUCTIU, in order to facilitate, streamline, and fulfill the commitments established between both parties. ATENEU INSTRUCTIU also informs of the possibility of exercising the rights of access, which allows the website user to know what personal data the administrator of this page holds and to obtain a response within 30 days, provided they retain personal data; rectification, which allows correcting errors in personal data, modifying inaccurate or incomplete data and ensuring the accuracy of the information; objection, which may be requested so that data processing is not carried out; erasure, which allows the removal of inadequate or excessive data; restriction, by which you may request that processing of your data be limited when you have exercised your right to rectification of your personal data; and portability, so that the user can obtain a copy of the personal data they have provided to the website in order to transmit it to other services. These rights may be exercised by any means that provides proof of sending and receipt to the address of the website administrator or to the email administracio@ateneuinstructiu.com, providing proof of identity. The data subject has the right to file complaints with the Supervisory Authority, AEPD, ACPD, and AVPD.

These clauses have been drafted by GRUP QUALIA, which grants a certificate in digital image format so that it can be displayed on your website.
